Budget bill [sentencing – mitigating factors]

H.E.A. 1001, P.L. 213-2015
Effective: § 261 effective July 1, 2015 
Amends IC 35-38-1-7.1 to add the fact that a person has post-traumatic stress disorder, traumatic brain injury, or a post concussive brain injury to the list of mitigating factors that a court may consider as favoring suspending a sentence and imposing probation. This legislation also authorizes the court to require a person with one of these conditions to receive treatment for the person’s injuries if the court suspends the sentence and orders probation.
