DOC commitments and motorboat OWI

The Senate Committee on Corrections & Criminal Law heard SB 142 authored by Sen. R. Michael Young on DOC commitments and motorboat OWI. The bill (1) permits a person convicted of a Level 6 felony to be committed to the DOC if the person has received an enhanced sentence for being a habitual vehicular substance offender; and (2) requires an enhanced penalty for motorboat OWI if the person has a previous conviction under a repealed version of the crime. A representative of the Indiana Prosecuting Attorneys Council testified in support of the bill, noting that current law permits up to a nine-year sentence for a repeat Level 6 offense, but inadvertently precluded that time from being served in DOC. The representative also testified that the bill corrects an erroneous citation to a pre-1995 version of the motorboat OWI statute. The bill passed 8-0.
