Employees and expungement

The Senate Corrections and Criminal Law Committee heard SB 267, authored by Sen. Taylor, on employees and expungement. Existing law prohibits job/license applications from questioning applicants concerning expunged arrests or convictions; the bill extends the prohibition to questions in interviews, and establishes a Class C infraction for violations (Class B infraction for repeat offenses). Sen. Taylor explained that some employers circumvent the existing prohibition by asking in interviews questions that are prohibited on applications; and that a penalty is needed to deter violations.
The bill was amended by consent to correct an oversight in existing law, noted by a Madison County judge, that requires the BMV to expunge records of convictions, but not violations that were dismissed or never charged. The bill was amended by consent, and passed 8-1.
