The Senate Judiciary Committee heard SB 12 authored by Sen. Young on financial crimes against the elderly. The bill provides immunity to financial institutions for the release or decision not to release financial records to law enforcement or adult protective services if illegal activity is reasonably suspected. The bill also authorizes a court to order a person convicted of exploitation of a dependent or endangered adult to disgorge all or some of the property the person received as a result of the death of the dependent or endangered adult.
A technical amendment was adopted by consent. Testimony in support of the bill was heard from the Division of Aging Services of the Family and Social Services Administration, the Prosecuting Attorneys Council, Indiana Bankers Association and a representative of Area Agencies on Aging. The amended bill passed 9-0.
