The Senate Civil Law Committee heard Sen. Waltz’s SB 253 on uniform fiduciary access to digital assets. This bill enacts the Revised Uniform Fiduciary Access to Digital Assets Act of the National Conference of Commissioners on Uniform State Laws. The bill provides that a court may grant a guardian access to the digital assets of the protected person and that, under certain circumstances, a custodian is required to disclose to a guardian a catalogue of electronic communications sent or received by the protected person. Sen. Waltz stated that the bill allows an asset designee to determine what happens to social media accounts after a person dies.
The bill was amended by consent and supported by the Indiana Uniform Law Commission. The bill passes as amended, 6-0.
