The Civil Law Committee heard SB 331 authored by Sen. Zakas on adult permanent guardianship cases. The bill provides for the reporting of adult permanent guardianship cases to the National Instant Criminal Background Check System (NICS) to comply with federal law. Sen. Zakas presented an amendment to the committee, which was adopted by consent, to specifically require the court to make a finding if the individual meets the federal definition of “mental defective” before these cases could be subject to reporting to NICS. Judge Peter Foley, Morgan Superior Court # 2, testified in favor of the bill on behalf of the Probate Committee of the Indiana Judicial Conference. The bill passed as amended 6-0.
