The Senate Judiciary Committee heard SB 66 on civil rights authored by Sen. R. Michael Young and Sen. Boots. This bill defines certain provisions of the Constitution of the State of Indiana as “fundamental rights” and prohibits the government from substantially burdening a fundamental right unless the governmental entity demonstrates that the application of the burden to the person: (1) is in furtherance of a compelling governmental interest; and (2) is the least restrictive means of furthering that compelling governmental interest. Sen. R. Michael Young explained that this bill would raise the judicial level of review from rational basis to strict scrutiny. Sen. Steele announced that no testimony would be taken, and there would be no vote on this bill.
