The Senate Corrections and Criminal Law Committee heard HB 1235 concerning drug offenses and sponsored by Rep. R. Michael Young. The bill allows a prior conviction for dealing in a synthetic drugs to be considered an enhancing circumstance and would make the sentence for dealing in a controlled substance as a Level 2 offense non-suspendible.
The Indiana Prosecuting Attorneys Council and the Indiana Governor’s Office testified in support of the legislation. The Indiana Public Defender’s Council, the Indiana State Bar Criminal Justice Section, and the Indiana Judges Association all testified in opposition to the bill. The bill was held for amendment.
