Drug offenses

The Senate Corrections and Criminal Law Committee heard, for amendment and vote only, HB 1235, sponsored by Sen. R. Michael Young and Sen. Steele, on drug offenses. The bill permits a prior conviction for dealing in a synthetic drug to be used as an enhancing circumstance, and makes the minimum sentence non-suspendible for Level 2 felony drug offenses.
Sen. Lanane introduced an amendment to remove the enhancing-circumstance provision, and to make non-suspendible only Level 2 offenses for dealing heroin if the person has a prior drug dealing conviction for a drug other than marijuana, hashish or hash oil, salvia, or a synthetic drug. The bill was amended by 7-2 vote, and passed as amended 7-1.
