The House Public Health Committee heard SB 80, sponsored by Rep. Smaltz and Rep. Davisson, on pharmacists and ephedrine. The bill authorizes a pharmacist to deny the sale of ephedrine or pseudoephedrine if in the pharmacist’s professional judgment, there is not a legitimate medical and pharmaceutical needed for these drugs. The bill provides civil immunity for the exercise of the pharmacist’s professional judgment in these circumstances. The bill also requires the Indiana Board of Pharmacy to adopt rules regarding the refusal to sell ephedrine or pseudoephedrine.
An amendment was adopted encouraging theft prevention activities. The amended bill passed 6-5.
