Legislative Update

Tort claims immunity

March 2, 2016 Filed Under: Civil

The House Judiciary Committee reheard SB 146 sponsored by Rep. Friend and Rep. Porter on tort claims immunity. The bill provides that the tort claims act applies to a claim against certain approved postsecondary educational institutions if: (1) the institution has complied with certain data sharing requirements; and (2) the claim relates to a breach of this data.
An amendment was adopted by consent to declare that tort claims immunity under this bill does not apply to lawsuits filed before March 30, 2016.  A second amendment addressing city legislative body vacancies was also adopted by consent.  These amendments supplant the two amendments adopted last week.  The amended bill passed 11-0.
