The Senate Corrections and Criminal Law Committee heard Sen. Young’s SB 169 on expungement. The bill prohibits a sex or violent offender from expunging a misdemeanor conviction, provides that arrest records may be expunged if a related conviction is expunged or if the person has completed a diversion program, and permits the expungement of civil forfeiture records if a related arrest or conviction is expunged.
Sen. Young explained that there is some question on the effect of the civil forfeiture section of the bill, so he asked that the bill be held for a vote at the next meeting. The Indiana Prosecuting Attorneys Council testified in favor of the bill. The Indiana Public Defender Council testified in support of the main provisions of the bill, but testified against the sex offender portion of the bill because it removes judicial discretion for some offenses. The bill was held for a vote at the next meeting.
