Legislative Update

Accessing child pornography

February 3, 2017 Filed Under: Criminal

The House Committee on Courts and Criminal Code heard Rep. Washburne’s HB 1091 on accessing child pornography.  Rep. Washburne explained that the bill would criminalize viewing child pornography without requiring that it also be possessed. A representative of the Prosecuting Attorneys Council, speaking in support, explained that Indiana law presently only criminalizes downloading child pornography and that the bill would make it a crime to view the pornography by streaming it online.
By consent an amendment offered by Rep. DeLaney was adopted to make it a crime for a teacher to send pornography to students. The amended bill passed 11-0.
