The Senate Civil Law Committee heard Sen. Sandlin’s SB 549 on personal information privacy. This bill amends the definition of “abandoned” for purposes of protection of health records and personal information possessed by certain professionals. It permits the Attorney General to file an action against a professional to recover incurred costs related to abandoned records. The bill also applies current law concerning data base security to a data base owner currently exempt from the law if the data base owner does not have or implement a plan to safeguard personal information after ceasing to be a covered entity under the federal Health Insurance Portability and Accountability Act.
The Indiana Attorney General’s office testified that they are currently neutral on the bill. The Indiana Hospital Association testified to explain portions of the bill. The bill passed 8-0.
