Legislative Update

Catastrophic injury

February 10, 2017 Filed Under: Criminal

The Senate Corrections and Criminal Code Committee heard Sen. Young’s SB 229 on catastrophic injury.  Sen. Young explained that the bill authorizes a court to impose an additional fixed term of five to ten years if a person commits one of certain offenses which cause the victim to suffer a “catastrophic injury” as defined by the bill.
Sen. Young offered an amendment, adopted by consent, which adds OWI and boating OWI to, and removes “rioting” from, the list of offenses subject to the additional term.  Sen. Lanane offered an amendment, also adopted by consent, to make it clear that the blindness, paralysis, or other disability making the injury catastrophic must last at least one year. The bill passed as amended 8-0.
