Drug dealing resulting in death

The Senate Corrections & Criminal Law Committee heard Sen. Houchin’s SB 324 on drug dealing resulting in death. The bill provides that a person who knowingly or intentionally manufactures, finances the manufacture of, delivers, or finances the delivery of cocaine, a narcotic drug, methamphetamine, or a schedule I, II, or III drug, the delivery of which results in the death of the user, commits a Level 2 felony. It also provides that a person who knowingly or intentionally manufactures, finances the manufacture of, delivers, or finances the delivery of a schedule IV drug, the delivery of which results in the death of the user, commits a Level 3 felony.
The Indiana Attorney General’s Office and the Madison County Prosecutor testified in favor of the bill. The Indiana Public Defender Council testified in opposition to the bill. The bill was held for amendment.
