The Senate Corrections and Criminal Code Committee heard Sen. Young’s SB 169 on expungement. The bill prohibits a sex or violent offender from expunging a misdemeanor conviction, provides that arrest records may be expunged if a related conviction is expunged or the person completed a diversion program, and permits expungement of civil forfeiture records if a related arrest or conviction is expunged.
Sen. Taylor offered an amendment to prohibit law enforcement access to expunged records if the access was only for “administrative” purposes such as evaluating employment applications; the amendment was opposed by the Prosecuting Attorneys Council and was defeated 5-3. The bill then passed 9-0.
