Forfeiture

For amend and vote only, the Senate Corrections and Criminal Law Committee heard Sen. Boots’ SB 8 on forfeiture.  The bill permits seized property to be forfeited to the state only if the owner of the property has been convicted of a criminal offense, repeals a provision permitting the state to turn over seized property to the federal government, and makes conforming amendments and repeals an obsolete section.
The bill was amended to provide procedures for return or release of seized property and establish a new procedure for civil forfeiture.  The amended bill passed 8-1.
