Petitions for educational support

The Senate Civil Law Committee heard Sen. Delph’s SB 374 on petitions for educational support. Sen. Delph explained that the bill authorizes a court to issue an educational support order until a child becomes 23 years of age.
A constituent explained that when her husband filed for divorce their child was then over age 19 and accordingly was not eligible under current law to receive educational support. Attorney Andrew Soshnick, former chair of the ISBA Family and Juvenile Law Section, requested an amendment to reduce the bill’s age at which educational support may be sought from 23 to 21. After extensive discussion, the bill failed by a 4-4 vote.
