Criminal and civil liability for ransomware

For amend and vote only, the Senate Corrections and Criminal Law Committee heard HB 1444, sponsored by Sen. Zay and Sen. Doriot, on criminal and civil liability for ransomware.  The bill was amended by consent to specify that a person that controls, directly or indirectly, a person that violates certain requirements concerning unlawful telephone solicitation (the “do not call” statute) is equally liable for the violation and provide that a person who commits a computer offense involving ransomware or a hoarding program commits a deceptive act actionable by the attorney general.  The bill was also amended by consent to define “pecuniary loss” for purposes of an offense against computer users, increase the penalty for an offense against computer users based on the pecuniary loss, and specify that certain offenses against computer users are deceptive acts actionable by the Attorney General.
