Treatment of out-of-state convictions in sentencing

The Courts and Criminal Code Committee heard HB 1033 authored by Rep. Washburne on treatment of out-of-state convictions in sentencing. The bill provides that, for purposes of the law regarding death sentences and sentences for felonies and habitual offenders, a Level 6 felony conviction, in a jurisdiction other than Indiana, is one for which the offender might have been imprisoned for more than one year but less than two and one-half (2 1/2) years.
Testimony was presented in support of the bill by Dave Powell of the Indiana Prosecuting Attorneys Association. No amendments were offered. The bill passed 8-0.
