Legislative Update

Court Appointed Child Advocate immunity

January 19, 2018 Filed Under: Family

The Senate Committee on Civil Law heard SB 130 authored by Sen. Bohacek on court appointed child advocate (CASA) immunity. The bill provides immunity from civil and criminal liability for a guardian ad litem program, a CASA program, and an employee, contract employee, or volunteer for a guardian ad litem program or court appointed special advocate program when a child is placed on a waiting list for guardian ad litem or CASA services.
The bill was amended to remove criminal immunity and contract employees from immunity coverage, narrowing the liability simply to the civil liability resulting from a waiting list. A representative from Family Advocates testified in support of the bill. The amended bill passed 4-0.
