Pretrial diversion

The House Courts and Criminal Code Committee heard HB 1057 on pretrial diversion authored by Rep. Steuerwald. The bill allows prosecutor diversion programs to charge a $75 initial fee for felony diversion cases, permit additional program fees that are reasonably related to the person’s rehabilitation and approved by the court, and require the monthly user fee not be collected beyond the maximum possible length of the sentence.
The Committee amended the bill to increase the monthly fee from $10 to $20.  The Indiana Prosecuting Attorneys Council testified in support of the bill. Indiana Public Defender Council testified in opposition. The bill passed as amended 8-0.
