The Senate Corrections and Criminal Law Committee held further hearing on SB 64 on sentence modification authored by Sen. Young. The bill provides that without the consent of the prosecuting attorney, a court may not reduce the sentence of a person sentenced under a plea agreement if the reduction was not authorized by the plea agreement.
At the first hearing, testimony was presented in support of the bill by the Indiana Prosecuting Attorneys Council and against the bill by the Indiana Judges Association. The Indiana Public Defender Council presented testimony both in support of the bill and against the bill.
At this week’s hearing, an amendment was adopted clarifying that defendant may not seek modification of a binding plea agreement. The amended bill passed 7-0.
