The House Judiciary Committee heard HB 1015 concerning unlawful indemnity agreements authored by Rep. Torr. The bill addresses indemnity agreements for certain design-build contracts, and specifies that a provision in a professional service contract that requires indemnification and defense of promise for certain liability is void.
The Committee amended the bill to also provide that “sole negligence” for liability purposes under a construction or design contract does not include vicarious liability, imputed negligence, or assumption of nondelegable duty. The amended bill passed 8-2.
