Legislative Update

Controlled substance dispensing

February 2, 2018 Filed Under: Civil

For amend and vote only, the Senate Civil Law Committee heard SB 339 authored by Sen. Merritt on controlled substance dispensing. The bill requires a pharmacy and pharmacist to sell or dispense a schedule II controlled drug in a lockable vial and bill the drug manufacturer for the cost of the lockable vial. The bill also provides for immunity from liability for a pharmacy, pharmacy personnel, and pharmacist in certain circumstances.
The bill was amended to allow for the option of a lockable vial, but not require the lockable vial. The amended bill passed 4-1.
