Legislative Update

Misleading or inaccurate caller identification

February 2, 2018 Filed Under: Civil

The Senate Civil Law Committee heard SB 222 authored by Sen. Head on misleading or inaccurate caller identification. This bill provides that a person who knowingly violates the statute concerning the transmission of misleading or inaccurate caller identification information commits a Class A misdemeanor or if the person has a previous unrelated conviction under the statute, a Level 6 felony. Current law provides that a person who knowingly violates the statute commits a Class B misdemeanor or if the person has a previous unrelated conviction under the statute, a Class A misdemeanor.
The bill was amended to remove any new criminal provisions from the bill but allows the Attorney General to pursue offenders and assess a civil penalty. The amended bill passed 7-0.
