Legislative Update

Disputes involving homeowners associations

February 22, 2019 Filed Under: Civil

For amend and vote only, the House Judiciary Committee heard Rep. Burton’s HB 1138 on disputes involving home owners associations. The bill provides that if mediation is mandatory if either party requests it. The bill further provides that if neither party requests mediation, or if mediation is unsuccessful, a claimant may begin legal proceedings.
The House Judiciary Committee originally heard the bill on February 4, 2019. Testifying in support of the bill was an attorney and part time lobbyist for homeowners’ associations.  Testifying in opposition was the Indiana Trial Lawyers Association. The bill was held for further amendment.
The House Judiciary Committee again heard the bill on February 18, 2019. The bill was amended to allow for mandatory mediation instead of binding arbitration.  The amended bill passed 10-0.
