The Senate Committee on Corrections and Criminal Law heard HB 1078 sponsored by Sen. M. Young regarding the commitment of Level 6 offenders to the DOC. This bill provides that a court may commit a person convicted of a Level 6 felony to the department of correction if the person is a violent offender or has two prior unrelated felony convictions.
The bill was amended by consent to provide that a violent offender is an individual convicted of certain offenses and not charged with certain offenses. The Indiana Prosecuting Attorneys Council, the Indiana Sheriff’s Association, and the Association of Indiana Counties testified in support of the bill. The Indiana Public Defender Council testified in opposition.
The amended bill passed at 7-1.
