Legislative Update

Theft by public servants

March 22, 2019 Filed Under: Criminal

The Senate Judiciary Committee heard HB 1192 on theft by public servants, sponsored by Sen. Koch.  The bill specifies that in the case of a public servant who criminally exerts unauthorized control over public funds of the public servant’s employer, the employer may be reimbursed from the public servant’s public pension fund contributions and benefits. The bill also provides that assets of the judges’ retirement system and the prosecuting attorneys retirement fund are exempt from levy, sale, garnishment, attachment, or other legal process. Current law provides similar exemptions for certain funds administered by the Indiana public retirement system.
The bill was amended to make correct a punctuation error.  The Indiana Prosecuting Attorneys Council testified in support of the bill.  The amended bill passed 10-0.
