Legislative Update

Drug dealing

March 29, 2019 Filed Under: Criminal

The House Courts and Criminal Code Committee heard SB 110 on drug dealing sponsored by Rep. McNamara. This bill adds an item to the existing list of enhancing circumstances for offenses relating to controlled substances and that an enhancing circumstance means that the person committed the offense in, on, or within 100 feet of a drug treatment facility.
The bill was amended to  make a technical amendment and clarify that the violation applies only when treatment is occurring. The amendments were adopted by consent.   The Indiana Prosecuting Attorneys Council testified in favor of the bill.  The Indiana Public Defender Council expressed concern that drug treatment meetings could be held at unmarked locations, like a church or community center. The amended bill passed 11-0.
