Legislative Update

Full faith and credit for tribal court orders

January 31, 2020 Filed Under: Judicial Administration

The House Judiciary Committee heard HB 1306 on full faith and credit for tribal court orders by Rep. DeLaney and Rep. Steuerwald. Rep. DeLaney testified that this bill is being brought because Indiana has an active federal tribe, the Pokagan band. This bill requires that, under certain circumstances, a court of record in Indiana shall give full faith and credit to judgments and orders of a tribal court of a federally recognized Indian tribe.
A Pokagan Tribal Prosecutor testified in favor of the bill, explaining that the Pokagan band has adopted a rule so it would be reciprocal. The bill was amended to specifically name the Pokagan Band.
The amended bill passed 12-0.
