Marijuana quantities

The Senate Corrections and Criminal Law Committee heard SB 236 on marijuana quantities authored by Sen. Young. The bill specifies, for purposes of operating while intoxicated, a minimum amount of delta-9-tetrahydrocannabinol (THC) and the manner in which a chemical test for THC must be conducted. The bill also requires the state department of toxicology to adopt rules.  Under Indiana law, it is a Level 6 felony for a person to cause  an accident resulting in injury with marijuana  in the body. 
An amendment was adopted establishing a defense to driving with marijuana in the body. The amendment protects Indiana citizens who may have engaged in legal activity in another state (marijuana use), then are subsequently involved in an accident resulting in injury in Indiana.  
The Indiana Prosecuting Attorneys Council is neutral on the bill as amended. The Indiana Public Defender Council and a member of the Indiana bar testified in support of the amended bill. The amended bill passed, 5-2.
