The Senate Corrections and Criminal Law Committee heard SB 201 on operating while intoxicated authored by Sen. M. Young. The bill provides a defense to prosecution for a person who operates a vehicle with marijuana or its metabolite in the person’s blood when the person was not intoxicated, did not cause a traffic accident, and the substance was identified by means of a chemical test.
At last week’s hearing, the Public Defender Council testified in support of the bill and the Indiana Prosecuting Attorneys Council testified but remained neutral. The bill was held over to this week’s hearing.
The Committee continued discussion of the bill, which passed 4-3.
