The Senate Corrections and Criminal Law Committee heard HB 1256 sponsored by Sen. M. Young regarding juvenile court jurisdiction. Author Rep. McNamara presented the bill which provides that a child who: (1) commits indecent display by a youth; or (2) commits dangerous possession of a firearm or provides a firearm to another child in certain circumstances; has committed a delinquent act subject to the jurisdiction of a juvenile court.
An amendment was proposed to remove child firearm offenses from the automatic waiver statute. The amendment failed.
The Indiana Prosecuting Attorneys Council testified in support of the bill. The following organizations testified in support of the failed amendment, but did not render testimony on the bill as written: State Public Defender, VOICES, New Breed of Youth, Marion County Commission on Youth, Interrupting Racism for Children, Indiana Public Defender Council, Indiana Coalition for Youth Justice, and Central District United Methodist Women testified in opposition. The bill passed 7-1.
