The House Courts and Criminal Code Committee heard SB 201 sponsored by Rep. John Young regarding operating while intoxicated. The bill provides a defense to prosecution for a person who operates a vehicle with marijuana or its metabolite in the person’s blood when the person was not intoxicated, did not cause a traffic accident, and the substance was identified by means of a chemical test.
The Indiana Public Defender Council and Indiana Prosecuting Attorneys Council testified in support of the bill. The bill passed 11-0.
