The House Judiciary Committee heard SB 365 on immunity for physician wellness programs sponsored by Rep. Schaibley. This bill defines “wellness program” for physicians. It also specifies that the proceedings and deliberations of a wellness program are confidential, but allows a court to order in writing the release of confidential or privileged information belonging to a wellness program after a hearing if the court makes specified findings. The bill also provides that any member, consultant, or participant who comprises or participates in a wellness program is immune from civil liability and damages, including punitive damages, for any act or omission related to the person’s role in the wellness group.
On March 16, 2021, the Indiana State Medical Association and Indiana University Health testified in favor of the bill. The bill was held for amendment.
On March 24, 2021, the Committee amended the bill to add an immunity provision. The amended bill passed 8-0.
