The Senate Corrections and Criminal Law Committee heard HB 1293 sponsored by Sen. M. Young regarding criminal appeals. The author, Rep. Jeter, introduced the bill which provides that an order granting a motion to discharge a defendant before trial may be appealed to the supreme court or the court of appeals. The bill provides that the state may appeal an interlocutory order if the trial court certifies the appeal and the court on appeal makes certain findings.
The Indiana Prosecuting Attorneys Council testified in support of the bill. The Indiana Public Defender Council testified in opposition. The bill passed 8-1.
