The House Judiciary Committee heard HB 1208 on various probate and trust matters authored by Rep. John Young. This bill makes technical corrections to the law on health care advance directives, amends several provisions related to notices to be more consistent with the Rules of Trial Procedure, resolves inconsistencies in two sections of the chapter on dispensing with administration, authorizes the appointment of a special administrator under certain circumstances and the procedure for appointment, makes technical corrections to the section concerning electronic wills, and amends two definitions of electronic power of attorney. It also provides that any objection to a final account and petition for distribution of a decedent’s estate must be filed 14 days before the hearing. The bill eliminates docketing a trust and identifies permissible methods of filing a copy of a trust instrument with the court.
Probate attorney Jeff Dible testified in favor of the bill. The bill passed 10-0.
