The House Courts and Criminal Code Committee heard HB 1283 on burden of proof for exoneration payments authored by Rep. Steuerwald.The billprovides that a person applying to the Indiana Criminal Justice Institute seeking compensation for wrongful incarceration must prove that he or she is actually innocent by a preponderance of the evidence.
The Indiana Criminal Justice Institute, Indiana State Public Defender, Indiana Public Defender Council, and the IU McKinney Wrongful Conviction Clinic testified in support of the bill. The bill passed 9-0.
