The Senate Judiciary Committee heard SB 165 on noncompliant prosecutor authored by Sen. M. Young. The bill permits the Attorney General to request the appointment of a special prosecuting attorney if a prosecuting attorney is categorically refusing to prosecute certain crimes and establishes a procedure for the appointment of a person to serve as a special prosecuting attorney to prosecute cases that the county prosecuting attorney is refusing to prosecute.
Sen. Sandlin and representatives from Indianapolis and Indiana Fraternal Order of Police and the Attorney General’s Office testified in favor of the bill. Representatives from Indiana Public Defender Council, Indiana Prosecutor Attorneys Council, and ACLU of Indiana testified against the bill. The bill passed 7-3.
