Uniform trust decanting act and trustee duties

The Senate Judiciary Committee heard HB 1205 concerning uniform trust decanting and trustee duties sponsored by Sen. Freeman and Sen. Koch.  Rep J. Young, author, presented the bill which repeals current statutes on decanting and replaces them with provisions from the Uniform Act which are modified to align with other provisions in Indiana Code, and amends provisions regarding filing of a trustee vacancy and the assignment of duties for multiple new trustees. 

Probate attorney Jeff Dible testified in favor of the bill. The bill was amended by consent to address some technical drafting issues. The amended bill passed 11-0.
