The Senate Judiciary Committee heard HB 1208 concerning various probate and trust matters sponsored by Sen. Freeman and Sen. Koch. Rep J. Young, author, presented the bill. The bill makes technical corrections to the law on health care advance directives, amends several provisions related to notices to be more consistent with the Rules of Trial Procedure, resolves inconsistencies in two sections of the chapter on dispensing with administration, authorizes the appointment of a special administrator under certain circumstances and the procedure for appointment, makes technical corrections to the section concerning electronic wills, and amends two definitions of electronic power of attorney. It also provides that any objection to a final accounting and petition for distribution of a decedent’s estate must be filed 14 days before the hearing. The bill eliminates docketing a trust and identifies permissible methods of filing a copy of a trust instrument with the court.
The bill was amended to restore current code provisions that the clerk must sign and date notices and to insert the contents of SB 132 on wrongful death.
Probate attorney Jeff Dible testified in favor of the bill. The amended bill passed 11-0.
