Legislative Update

Child molesting

January 27, 2023 Filed Under: Criminal

The Senate Committee on Courts and Criminal Code heard SB 301 authored by Sen. Brown on child molesting. The bill makes the acts requiring a person convicted of child molesting to be sentenced in accordance with the alternative Level 1 sentencing range an element of the crime of child molesting.

The bill was amended to clarify sentencing options for child molest based on age of the victim, and to add the crime of rape to the definition of credit restricted felon.

Indiana Prosecuting Attorneys Council testified in favor of the bill. Indiana Public Defender Council testified in favor of the bill but against the amendment adding rape to credit time restriction.

The amended bill passed 8-0.
