The House Judiciary Committee heard HB 1252 for immunity for escort of a banned person authored by Rep. Hatfield. This bill specifies that under the Tort Claims Act, a governmental entity or employee acting within the scope of employment is not liable for loss resulting from injury to a person or property of a person who is under supervision of a governmental entity and subject to a court order requiring the person to be escorted by a county police officer while the person is on or in a government building owned by a county building authority.
Representatives from the Vanderburgh Building Authority testified in favor of the bill, and explained the reason for the bill. When judges or other governmental officials are threatened, the judges issue an order that if that person enters the building they must be escorted by a deputy. In 2000, the Vanderburgh Building Authority was sued for this practice.
