The House Judiciary Committee heard HB 1365 pertaining to the definition of machine gun authored by Rep. Gove and Rep. Garcia Wilburn. The bill revises, for purposes of an enhancement and certain criminal offenses, a definition of “machine gun” to include a particular part or combination of parts designed and intended for use in converting a weapon into a weapon that fires automatically more than one shot, without manual reloading, by a single function of the trigger. The bill modifies a separate definition of “machine gun”.
The bill was amended by consent to add an exception for a gun never required to be registered. Testimony in support of the bill was presented by the Indianapolis Metropolitan Police Department, Indiana Fraternal Order of Police, Indiana Association of Police Chiefs, Indiana Prosecuting Attorneys Council, and the Indiana Sheriffs’ Association. Representatives of the Indiana Public Defenders Council and Fos Tech testified against the bill.
The amended bill passed 9–2.
