Legislative Update

Town and city court judges

February 17, 2023 Filed Under: Judicial Administration

The House Courts and Criminal Code Committee heard HJR 6 on town and city court judges authored by Rep. Aylesworth for amend and vote only. The bill provides that county, township, and town residency requirements prescribed by Article 6, Section 6 of the Constitution of the State of Indiana do not apply to city or town court judges.

Rep. Aylesworth introduced an amendment rewriting the bill to provide that the judge of a city or town court shall reside in: (1) the county in which the city or town court is located; or (2) the bordering Indiana county that is the closest Indiana county to the city or town in which the court is located. The amendment was adopted by voice vote. The amended resolution passed 10-1.
