Legislative Update

Court ordered pregnancy and childbirth expenses

March 10, 2023 Filed Under: Family

The Senate Judiciary Committee heard HB 1009 authored and presented by Rep. Rowray on court ordered pregnancy and childbirth expenses sponsored by Sen. Brown and Sen. Alexander. The author, Rep. Rowray, introduced the bill which  amends Ind. Code § 31-14-17-1 to require the court to order the father to pay at least 50% of mother’s reasonable childbirth and pregnancy expenses.

This legislation amends the existing law to remove the word “necessary” from the phrase “reasonable and necessary expenses of mother’s pregnancy and childbirth” and adds the phrase “necessary expenses incurred in connection with the child’s birth” later in the statute and postpartum expenses to those already permitted by law.  The bill passed the committee 10-0.
