The Senate Judiciary Committee heard HB 1282 on limitation of liability for DCS contractors sponsored by Sen. Liz Brown and Sen. Tyler Johnson. Author Rep. Chris Judy presented the bill, which expands the limitation on civil liability for actions taken by non-profit DCS contractors in the course of their contractual obligations. This does not apply for wanton negligent, knowing, or intentional breaches of duty or harm. Such claims must instead be brought against DCS and the bill limits recovery .
Indiana Trial Lawyers’ Association testified in opposition. CEO of Lasting Change (service provider) and Indiana Association of Resources and Child Advocacy testified in favor. The bill passed 6-5.
