The Senate Corrections and Criminal Law Committee heard HB 1142 on law enforcement recordings sponsored by Sen. Freeman and Sen. Sandlin. The author, Rep. Prescott, introduced the bill which provides that the direct cost that a state or local agency may charge for providing a copy of a law enforcement recording (recording) includes labor costs incurred to: (1) obscure non-disclosable information in the recording; and (2) perform an administrative review of the recording to determine if all non-disclosable information has been obscured. The bill also provides that if a court issues an order for disclosure of a law enforcement recording, any copy of the recording must be made by the public agency.
The bill was amended by consent to provide that the costs of reviewing and obscuring non-disclosable electronic data may not exceed reasonable attorney’s fees if the actions are performed by an attorney.
The Indiana Sheriffs’ Association testified in support of the bill. The amended bill passed 7-0.
